1. About these Terms

These Terms of Use govern access to and use of Nusatera, operated by Jusni Iljas Al Djabbar Sdn Bhd. Nusatera includes our Discover content, Events services, Shop marketplace, account features and related pages, tools and communications.

By using Nusatera, you agree to these Terms and any additional terms that apply to a particular service. Marketplace purchases, sellers, events, returns, shipping, privacy and cookies are also governed by the policies linked from our Legal section.

2. Eligibility and accounts

You must have the legal capacity required to use the relevant Nusatera service. Where a user is a minor or otherwise lacks full legal capacity, use must occur with the involvement of a parent, guardian or other person authorised by law where required.

You are responsible for providing accurate account information, maintaining the confidentiality of your credentials and promptly notifying us of suspected unauthorised use.

3. Acceptable use

You must not use Nusatera to break the law, infringe another person’s rights, interfere with the platform, attempt unauthorised access, distribute malicious code, scrape or exploit the service in a manner that materially harms Nusatera or other users, or submit content that is fraudulent, unlawful or misleading.

4. Discover and editorial content

Discover may contain articles, interviews, guides, cultural material and other editorial content. Unless expressly stated otherwise, editorial content is provided for general information and does not constitute professional, legal, financial or other regulated advice. Views attributed to authors, contributors or interview subjects are their own.

5. Events

Event listings, registrations, tickets or participation may be subject to separate Event Terms. Programmes, speakers, venues, schedules and activities may change where reasonably necessary. Any specific cancellation or refund rights will be governed by the applicable event terms and Malaysian law.

6. Marketplace role

Nusatera operates an online marketplace through which independent sellers may offer goods or services. A product page should identify the relevant seller. Unless Nusatera is expressly identified as the seller, the seller is responsible for the goods or services it lists, including the accuracy of required product and business information and its obligations to buyers.

Nusatera may provide platform services such as listings, checkout, payments integration, customer support, order routing, dispute handling and logistics integrations. Additional Marketplace Terms govern buyer transactions and Seller Terms govern sellers.

7. Prices, orders and payments

Prices, charges, taxes and delivery costs applicable to an order should be shown before purchase. Orders are subject to availability, validation and the applicable seller and marketplace rules. Payments may be processed by third-party payment providers and may be subject to their own service terms.

8. Seller and product information

Sellers are expected to provide accurate and non-misleading information required for electronic trade transactions, including relevant identity or business details, product or service characteristics, pricing, payment methods, sale terms and estimated delivery information where applicable. Nusatera may require sellers to correct, supplement or remove listings that do not meet platform or legal requirements.

9. User content and reviews

If you submit reviews, comments, images or other content, you remain responsible for that content. You must have the rights needed to submit it. You grant Nusatera a non-exclusive licence to host, display, reproduce and use that content as reasonably necessary to operate, promote and improve the platform, subject to applicable law and our Privacy Policy.

10. Intellectual property

Nusatera and its licensors retain rights in the platform, branding, design, software, editorial material and other protected content, except where content is expressly owned by sellers, contributors or other third parties. You may use Nusatera for personal or authorised business purposes, but may not reproduce or commercially exploit protected platform content without permission or a lawful basis.

11. Third-party services and links

Nusatera may connect to third-party payment, logistics, analytics, social, mapping or other services. Those services may have their own terms and privacy practices. We are not responsible for third-party services outside our reasonable control, but this does not affect any responsibility that cannot lawfully be excluded.

12. Platform availability and changes

We may maintain, update, change or discontinue features where reasonably necessary. We do not guarantee uninterrupted access, but will take reasonable steps to operate the platform reliably.

13. Suspension and termination

We may restrict or suspend access where reasonably necessary to protect users, investigate suspected misuse, comply with law, enforce applicable terms or protect the platform. Where appropriate, we may provide notice or an opportunity to address the issue.

14. Disclaimers and statutory rights

Nusatera is provided subject to applicable Malaysian law. Nothing in these Terms excludes, restricts or modifies any consumer right, guarantee, remedy or liability that cannot lawfully be excluded or limited.

To the extent permitted by law, we do not guarantee that all third-party seller content, external links, event information or user-generated content will always be complete, current or error-free.

15. Liability

To the extent permitted by law, each party is responsible for loss that is a reasonably foreseeable result of its breach, negligence or unlawful conduct. Nusatera is not responsible for losses caused solely by events outside its reasonable control or by a user’s failure to follow reasonable security or platform instructions. Any limitation in these Terms is subject to rights and liabilities that cannot legally be excluded.

16. Changes to these Terms

We may update these Terms to reflect changes in law, services or platform operation. Material changes will be communicated in an appropriate way. Continued use after revised Terms take effect constitutes acceptance where permitted by law.

17. Governing law

These Terms are governed by the laws of Malaysia. Any dispute will be handled by the courts or tribunals having jurisdiction in Malaysia, subject to any mandatory consumer dispute rights or other applicable legal process.
